Article 1: General
By using the Site, you agree to be bound by these Terms and Conditions and to use the Site in accordance with these Terms of Service, our Privacy Policy and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from DigitalBizGina.
Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service.
Article 1: Use of Website
The Website may only be used by persons aged 18 or older, or by minors with parental consent. The Customer agrees not to use the Website for unlawful purposes or in a manner that could damage or impair its operation. DigitalBizGina reserves the right to suspend or terminate access to the Website in case of misuse.
Any subscriber who does not meet these criteria will be deleted from our database as soon as this is brought to our attention. Likewise, any customer who does not meet these criteria will be reimbursed immediately and a return of the product(s) concerned will be required.
Article 2: Products and Services
DigitalBizGina provides Services consisting of digital products, online courses, coaching sessions, and related materials. Delivery of digital products is electronic. Unless expressly permitted, all purchased content is personal and non-transferable. Sharing, copying, or reselling Services without written authorization is prohibited.
By placing an Order for Products through the Service, you warrant that you are legally capable of entering into binding contracts.
Article 3: Price
All prices are stated in USD/EUR. Payments are due at the time of purchase and are processed securely via third-party providers such as Stripe or PayPal. Customers are responsible for any additional charges, such as taxes, currency conversion fees, or bank costs.
Article 4: Refund and Cancellation Policy
Given the digital nature of the Services, all sales are final and non-refundable. Exceptions may be made only in cases where a product is proven defective or inaccessible, provided the Customer notifies DigitalBizGina within 14 days of purchase. Separate refund or cancellation terms may apply to coaching programs, and such conditions will be stated clearly at purchase.
Article 5: Your information
If you wish to place an Order for Products available on the Service, you may be asked to supply certain information relevant to your order including, without limitation, your name, your email, your phone number, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or any other payment method(s) in connection with any Order; and that (ii) the information you supply to us is true, correct and complete.
By submitting such information, you grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of your order.
Article 6: Payment
Payment is due immediately on the date of the order, this includes pre-order products.
Payment can be made through any payment methods we have available, such as Visa, MasterCard, Affinity Card, American Express cards or online payment methods (PayPal, for example).
Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, We will not be liable for any delay or non-delivery of your order.
Article 7: Delivery
Delivery is made to the address you specified when placing your order (therefore, pay particular attention to the spelling of the address you enter and especially the postal code).
The risks will be your responsibility from the date on which the ordered products have left our premises. However, in the event of a lost package, we will do everything necessary so that you still receive your product or that you are reimbursed according to your warranty.
Article 8: Intellectual Property
All content, including but not limited to text, images, videos, templates, and downloadable resources, is the exclusive property of DigitalBizGina unless otherwise credited. The Customer may not reproduce, distribute, or exploit any material without prior written consent.
Article 9: Liability
DigitalBizGina endeavors to provide accurate and valuable information but does not guarantee specific results from the use of its Services. The Customer acknowledges that success depends on personal circumstances and effort. To the extent permitted by law, DigitalBizGina shall not be liable for indirect, incidental, or consequential damages arising from the use of the Website or Services.
Article 10: Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of The Netherlands. Any disputes shall be submitted to the exclusive jurisdiction of the competent courts in The Hague, The Netherlands.
Article 11: Changes to these Terms and Conditions
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and the Service.
